This Notice shall satisfy two (2) separate but related, procedural requirements for activities to be undertaken by the County of Clearfield.
Request for Release of Funds
On or about December 4th, 2020 the County of Clearfield will submit a request to the Pennsylvania Department of Community and Economic Development (DCED) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project in Lawrence Twp. Known as “Kerr Ave., Palmer & Patton Street Improvements.” Lawrence Twp. has allocated its entitlement CDBG funds from Ffy 2018, 2019, and 2020 in the total amount of $313,356 to improve storm drainage and rebuild the streets and shoulders of the above identified streets.
Finding of No Significant Impact
The County of Clearfield has determined that the listed project will have no significant impact on the environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Clearfield County Planning & Community Development Office, 212 E. Locust Street, Suite 128, Clearfield, PA 16830.
Public Comments
Any individual, group, or agency disagreeing with this determination or wishing to comment on the projects may submit written comments to Antonio Scotto-Chair, Clearfield County Board of Commissioners, 212 E. Locust Street, Suite 112, Clearfield, PA 16830. Comments may also be submitted via email at cccomm@clearfieldco.org. All comments received by or on December 4th, 2020, will be considered by the County of Clearfield prior to authorizing submission of a request to release of funds. Commentators should specify which part of this notice they are addressing.
Release of Funds
The County of Clearfield certifies to DCED that Antonio Scotto, in his capacity as Chair of the Clearfield County Board of Commissioners, consents to accept the jurisdiction to the Federal Courts if an action is brought to enforce responsibilities in relation the environmental review process and that these responsibilities have been satisfied. Objections to Release of Funds
DCED will consider objections to its release of funds and the County of Clearfield’s certification for a period of 15 days following the anticipated submission date or it’s actual receipt of the request (whichever is later) only if it is on one of the following basis: (a) the certification was not executed by the Certifying Officer of the County of Clearfield; (b) The County of Clearfield has omitted a step and failed to make a decision or finding required by HUD regulations at 24CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by DCED; or (d) another Federal Agency, acting pursuant to 40CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the stand point of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76), and shall be addressed to the PA Department of Community and Economic Development at: chrhowe@pa.gov Potential objectors should contact the State to verify the actual last day of the objection period.
